Negotiation of Planning Conditions and Section 106 Agreements

As part of our work supporting planning applications, we offer our assistance in negotiating planning conditions and S106 contributions. 

It’s all very well getting a planning permission, but the planning conditions are often fundamental and can sometimes leave you with an unimplementable permission, if they are not negotiated properly. We work with case officers to ensure that the planning conditions are fair, properly written and lawful.  

The sooner you know about what contributions are required to support a development the better, we work with the case officer to ensure the heads of terms for the S106 agreement are as clear as possible. We then work with your solicitor and the council’s solicitor to ensure the S106 agreement is progressed in a timely manner. This is, of course, even more critical when it relates to an appeal.

We can also assist with Deeds of Variation in the event that a new S106 is not required but an amendment to it would be.
